WHICH
IS THE RIGHT VISA FOR YOU?
| L-1 visa holders are able to quickly jump over one of the biggest hurdles to getting a Green Card - Labor Certification. This therefore is a popular visa if you own a business in your home country and that company transfers you to the USA to set up a new business or operate an existing business with substantially the same ownership. | |
| Visas
can be issued quickly. You may travel in and out of the U S A freely or
remain continuously providing you are still in status. You may obtain visas
for accompanying relatives, but they cannot work in the U S A without
obtaining a visa under another status.
E-2 VISA - TREATY INVESTOR Most of our clients find an E-2 Visa (Treaty Investor) is the most appropriate for them. You can qualify for an E-2 visa if you are a Citizen of a country that has an investor treaty with the U S A. This includes the United Kingdom and most other European countries. To qualify, you will need to invest in a U S business that employs you as an owner / operator or senior executive. Most people find the easiest way is to buy an existing business or start their own. Investment in stocks, land or holding companies will not work, as the company must be actively engaged in trade. This is not as difficult as it might appear and we can assist you with all aspects of purchasing or starting your own business in the U S A. The benefits of an E-2 visa are:
|
| You can work in the U S A for a U S business. | |
| Visas can be issued quickly. | |
| You can travel in and out or remain in the U S A continuously until your visa and status expire. | |
| There is no limitation on the number of extensions that can be granted so an E-2 can permit you to live in the U S A for prolonged periods. | |
| Accompanying relatives can be included in your visa and may stay in the U S A with you, but they may not work unless they obtain their own status and the appropriate visa. |
E-1 VISA- TREATY TRADER
This is also popular with overseas investors and often does not require a substantial investment, as does the E-2. Benefits are as follows:
| You can work legally in the U S A for a U S company when more than 50% of that company's business is trade between the U S and your home country. This trade can be either way. |
| Visas can be issued quickly. | |
| You may travel in and out at will or remain in the U S continuously until your visa and status expire. |
We have been able to give you an overview of the most popular visa possibilities. There are others, but every person’s situation is different and if you wish to proceed further, we need to have a detailed discussion with you to be able to find the right kind of business for you and advise you as to your best course of action. Please call us if you would like to realise your ambition of living and working in the USA. We can certainly help you.
